How the New Estate Tax Exclusion Affects Your Estate Plan

On December 17th, Congress revised the estate tax with a new law, TRA 2010, that sets the exclusion amount at $5 million per person for 2010 – 2012. However, this temporary adjustment to the estate tax exclusion disappears in 2013, and returns with an exclusion of $1 million per person. Update on Hawaii Estate & Transfer Tax

The State of Hawaii restored its Estate tax and Generation-skipping tax for estates having net assets in excess of $3.5 million. These taxes now also apply to Hawaii nonresident noncitizens having real property assets located in Hawaii in excess of $60,000.
